Superyacht Equanimity Holding Company Condemns Malaysian Government: A statement from the holding company of the 91.5-meter superyacht Equanimity condemns the Malaysian government, claiming misuse of the vessel has lead up to a court-ordered sale. The holding company, Equanimity (Cayman) Ltd. Has stated that no legally valid notice on the sale of the vessel has ever been received and that such a notice such be required under the law.
Citing ongoing proceedings in U.S. courts regarding the ownership and custody of the vessel, the holding company noted that requests continued to be filed before a U.S. judge as just hours before the statement was filed. Equanimity Ltd. stated that Malaysia’s unilateral actions to auction the yacht while there are pending court requests are an affront to the international rule of law. The statement claims that the United States had no advance knowledge regarding Malaysia’s seizure of Equanimity and presumably had no notices of Malaysia’s current actions in putting up the vessel for auction.
Additionally, the statement claims that Malaysia has docked Equanimity in a hazardous environment with polluted water and nearby smoke that are greatly damaging the vessel and reducing its resale value. The Malaysian government has been called “precipitous, ill-conceived and misguided” for allowing the yacht to continue running on generator power. It claims that Malaysia does not have, or does not want, to spend the necessary funds to properly maintain the vessel, which may lead to it being sold for a fraction of her fair market value.
The statement reads, in part, “To move for a sale in Malaysia immediately would be a remarkable violation of due process and international legal comity, and would call into question the actual ownership of the yacht for any potential buyer. These misguided actions would create a cloud on superyacht Equanimity’s ownership that could easily take years to resolve in several courts around the world.”
